Goodwin Procter’s Privacy & Data Security Practice is devoted to helping clients navigate privacy and data security matters that affect business in a proactive manner. We provide a wide range of services in the area of privacy and data security law, advising on the complex patchwork of federal, state and global requirements.
We help clients develop company-wide compliance programs and train employees to go beyond the “paper plan” and make protection of data a reality that translates into data security as a tangible business asset. We support clients in their interactions with regulators on data security matters. We help audit data flows and develop and implement privacy, document retention and security policies and compliance programs. Our attorneys structure and negotiate a variety of agreements involving data privacy and security issues, including outsourcing and services agreements. We also work with clients engaged in transaction diligence covering privacy and data security and advise on data transfers associated with business combinations or other transactions.
We counsel clients on avoiding and mitigating litigation risk, and engage in active litigation and dispute resolution, including class action litigation. We represent clients before government and regulatory agencies in investigations and enforcement proceedings, and in connection with breaches of data security. Our practice in the privacy area is complemented by our experience advising companies in other areas involving risk management, such as mergers and acquisitions, technology contracting, intellectual property, e-commerce, website development and management, and on-line content management and licensing.
