Areas of Practice

Paul F. Ware, Jr. is a partner and Chairman of the Litigation Department at Goodwin Procter LLP. Mr. Ware joined Goodwin Procter in 1974 and was elected a partner of the firm in 1978. He has served on the firm’s major committees, and is a member of the firm's Executive Committee and Management Committee. As a senior trial partner, his practice has included substantial commercial, financial and intellectual property litigation.

Work for Clients

Mr. Ware has represented numerous companies in significant litigation, including General Electric (environmental class action and technology cases), Eli Lilly (litigation against generic manufacturers), Pyramid Corporation (civil RICO and breach of contract) and Harvard  University  (False Claims Act and breach of contract). These and other matters have involved a spectrum of commercial and business disputes, including breach of contract actions, civil RICO, and sophisticated commercial litigation. Mr. Ware currently represents Harvard University in major civil litigation arising out of a federal grant to the Harvard Institute for International Development in advising the Russian government. He represented Eli Lilly in litigation brought by the company in New Jersey and Indiana for damages in connection with the launch of competitive products by generic manufacturers without FDA approval.

His electronics cases have included a jury trial for Wang Laboratories in which Wang successfully enforced its seminal patent on office automation systems, as well as other significant representations: Northern Telecom (program-controlled data entry devices); Motorola, Inc. (IBM compatible workstations); Grumman Corporation (diagnostic software); Codex Corporation (high speed modems); Astro-Med, Inc. (thermal printheads in telemetry and medical chart recorders); Dover Corporation/Universal Instruments (circuit board assembly equipment) and Honeywell’s (formerly Allied Signal) Bendix Avelex subsidiary (night vision weapons systems).

Mr. Ware has tried numerous cases to conclusion in Federal and State courts and has represented companies at trial in the courts of each of the New England states, California, Michigan, New York, New Jersey, Delaware, Florida, Illinois and Pennsylvania. less »

Professional Activities

Mr. Ware has served as a lecturer and panelist at numerous seminars. He also has served as a special Assistant Attorney General in Massachusetts as a special assignment to represent an agency of the Commonwealth of Massachusetts. Mr. Ware has been a member of the United States Magistrate Merit Selection Panel for the First Circuit. He is a member of the American Bar Association and the Massachusetts Bar Association, as well as a Fellow of the American College of Trial Lawyers. Mr. Ware is listed in Chambers USA: America’s Leading Lawyers for Business and The Best Lawyers in America.

Professional Experience

Mr. Ware is a former law clerk to a Judge of the United States District Court in Boston, Massachusetts. He previously served as Assistant United States Attorney in Boston and as trial counsel for the Office of Independent Counsel in the prosecution of the chief of European Operations of the CIA in the Iran Contra investigation. Mr. Ware has served as Special Counsel to the Massachusetts Commission on Judicial Conduct (2001-03), and was appointed in 2004 by the Governor of Massachusetts to the Commission on Public Counsel Services.

Bar and Court Admissions

Mr. Ware is a member of the state bars of New York, Massachusetts and the District of Columbia and of the federal bars in California, Michigan, Vermont, New Hampshire and Massachusetts. He is admitted to the U.S. Courts of Appeals for the First, Third, Sixth, Ninth and Federal Circuits. Mr. Ware has appeared pro hac vice in numerous jurisdictions, including New Jersey, Florida, California, Michigan, Indiana, Connecticut, Maine, New Hampshire, Rhode Island and New York.
