Deborah Schrier-Rape is a partner in the firm’s Business Law Department and a member of the Financial Restructuring Practice.  Ms. Schrier-Rape has had an exceptionally broad commercial litigation, transactional and reorganization practice over the past 25 years.  From litigating two of the largest fraudulent transfer actions in history, each at over $1 billion, to representing debtors and committees in retail reorganizations and liquidations, she brings experience from every point of view in distressed environments to her clients.  Representing debtors, committees and lenders both in and out-of-court restructurings, she combines an ability to aggressively litigate with a bent toward building consensus to try to minimize the costs while maximizing the outcome for her clients.  She has also served as a court appointed examiner and fee examiner in Chapter 11 cases.

WORK FOR CLIENTS

Ms. Schrier-Rape specializes in corporate restructuring and commercial litigation matters.  She has also acted as an examiner in complex Chapter 11 filings and as a fee expert and auditor.  She has recently represented lenders in real estate restructurings, a receiver in a hedge fund contentious dissolution and several telecoms in significant litigation in distressed situations and restructuring matters.  She also advises clients on in and out-of-court restructurings and acquisitions.

Ms. Schrier-Rape is a member of the American Bankruptcy Institute, the American Bar Association, the California Bar Association, the New York Bar Association, the Colorado Bar Association and the Texas Bar Association.  She has also been a lecturer at numerous continuing legal education seminars.

PROFESSIONAL EXPERIENCE

Prior to joining Goodwin Procter, Ms. Schrier-Rape was the principal of Schrier-Rape, P.C., where she was lead bankruptcy and litigation counsel in NextWave Personal Communications, Inc., et al. – a multi-billion dollar restructuring with complex litigation with the Federal Communications Commission that reached the U.S. Supreme Court.  Before that, she was a partner in the Dallas office of Andrews & Kurth, LLP, serving as head of the Dallas Bankruptcy Group.  After commencing her career in the bankruptcy group at Gibson, Dunn & Crutcher, she served as Zale Corporation’s Senior Restructuring and Associate General Counsel, facilitating that company’s successful emergence from contentious Chapter 11 proceedings.
