Areas of Practice

Paul Nemser, a partner in the firm’s Litigation Department, concentrates his practice in complex products liability, securities, business and environmental litigation. Mr. Nemser also has substantial experience in intellectual property and constitutional litigation. A significant part of Mr. Nemser’s practice has included appellate work and consulting on complex legal and evidentiary issues. He has tried cases in both state and federal courts in Massachusetts.

Work for Clients

Mr. Nemser has worked on industry litigation that is national and international in scope, most notably in defense of tobacco litigation in courts across the country. This has included third-party payor suits by state attorneys general, foreign governments and purported classes of union health and welfare funds. It has also included individual suits and class actions brought by smokers. In addition, Mr. Nemser has represented a large software company in defending several purported antitrust class actions in state and federal court.

Mr. Nemser’s experience in securities litigation includes defending a number of shareholder class actions, including cases involving high technology companies, banks and mutual funds. He has also represented individuals and corporations in government investigations of securities transactions and has participated in litigation related to corporate control. Mr. Nemser’s cases have frequently involved challenges to corporate accounting practices.

Professional Activities

A Fellow of the Massachusetts and American Bar Foundations, Mr. Nemser is a member of the Boston, Massachusetts and American Bar Associations and their Sections on Litigation. He is on the Executive Committee of the Lawyers Committee for Civil Rights Under Law of the Boston Bar Association and on the Board of Trustees of Volunteer Lawyers for the Arts. He is Chair of the Amicus Committee of the Boston Bar Association.

Publications/Presentations

Mr. Nemser’s book, Massachusetts Evidentiary Privileges will be published this summer. He is the author of the chapter on “Evidentiary Privileges” in Massachusetts Evidence: A Courtroom Reference. He was a member of the editorial board of the Massachusetts Law Review, in which he published an article about expert testimony.

Professional Experience

Mr. Nemser has been an instructor in the Writing Program at Boston University School of Law. Before joining Goodwin Procter, he was law clerk to the Honorable Paul J. Liacos of the Supreme Judicial Court of Massachusetts.

Bar and Court Admissions

Mr. Nemser is admitted to practice in Massachusetts, and before the Supreme Judicial Court, the U.S. District Court for the District of Massachusetts, the First and Sixth Circuit Courts of Appeals and the U.S. Supreme Court.
