Areas of Practice

Ira Levy, a partner in Goodwin Procter’s Litigation Department, has a diverse intellectual property practice, working on matters involving patents, copyrights and trademarks. He has extensive experience with disputes involving biotechnology, pharmaceuticals and chemistry; electronics, computers and telecommunications; mechanical devices; industrial and consumer products; and the Internet, new media and e-commerce. He is resident in the firm’s New York office.

Work for Clients

In the patent litigation area, Mr. Levy recently conducted a multi-day Markman hearing to construe a patent on insulin formulations and acted as lead counsel in a four-week jury trial on tympanic thermometer covers. He has litigated patents concerning enzymes, rug designs, VATS keys for use in General Motors vehicles, the EZ-Pass system and the packaging for the Oscar Mayer Lunchables product.

Before the Federal Circuit, Mr. Levy recently convinced a divided panel to adopt the statutory post-judgment interest rate, rather than a higher pre-judgment interest rate, to determine the amount of interest which attached to a reinstituted damage award which previously had been vacated. This resulted in a six-figure savings for the client.

In the trademark and trade dress area, Mr. Levy successfully represented Pepperidge Farm in obtaining a preliminary injunction against dilution of its Goldfish cracker-shape trademark, and defeating a request by Calvin Klein for an injunction against the launch of Ralph Lauren Romance perfume. Recently, his client Campbell Soup Company was awarded a preliminary injunction against the launch of a product found to violate the trademark and trade dress rights of Campbell’s V8 brand vegetable juice.

In the false advertising area, he has worked on behalf of Colgate-Palmolive, Hills Pet Foods, Stouffer Foods (Lean Cuisine), Kraft General Foods (Jell-O), and Claussen Foods (Claussen Pickles).

Professional Activities

Mr. Levy has been an active member of the New York Intellectual Property Law Association, International Trademark Association, American Intellectual Property Law Association, Association of Patent Law Firms, American Bar Association, Pharmaceutical Trademarks Group and the Legal Aid Society. He has also acted as pro bono counsel to the United Way of New York City and cyberangels.org. and is a past member of the Board of Directors of the New York Intellectual Property Law Association. At the request of the International Trademark Association, Mr. Levy was co-chair of its 2002 Trademarks in Cyberspace conference in New York and Brussels. He is listed in 2006 New York Super Lawyers, The International Who’s Who of Trademark Lawyers, 2005 and Euromoney’s Guide to the World’s Leading Experts in Patent Law.

Publications/Presentations

Mr. Levy has written numerous articles on the topics of intellectual property, patent, trademark and copyright laws that have appeared in The New York Law Journal and Metropolitan Corporate Counsel. He also authored chapters in Commercial Damages, published by Matthew Bender & Co., and the 2000 Wiley Intellectual Property Law Update, published by Aspen Law & Business. In addition, Mr. Levy maintains an active roster of speaking engagements on intellectual property audit, portfolio development, strategy and management, and Internet and new media matters.
