Work for Clients
Mr. Healy’s permitting experience includes the following major developments: - Logan Airport Capital Improvement Plan. Boston, MA. Mr. Healy has acted as lead outside counsel on National Environmental Policy Act (NEPA), Massachusetts Environmental Policy Act (MEPA), federal Clean Air Act (CAA), State Implementation Plan (SIP), federal Clean Water Act (CWA) and permitting compliance for a billion dollar international airport capital plan. Components of the plan included a new international terminal, new domestic terminals, new cargo buildings, new parking garages, roadway and utility improvements, power plant modifications, a new fuel distribution system, a new fuel storage facility, and a new hotel as well as other capital improvements. The capital plan was challenged by several lawsuits which were successfully resolved.
- Millennium Place. Boston, MA. Mr. Healy represented the developers of a $400 million mixed-use 1,300,000 square foot development on Boston Common which includes a hotel, two high-rise residential towers, retail stores, and a movie complex, among other uses. With Goodwin’s assistance the project moved through a complex approval process, including Massachusetts Environmental Policy Act (MEPA) review, city environmental review, Planned Development Area approval, and a rezoning, within an eight month period. - Central Artery/Tunnel Project. Boston and Cambridge, MA. Mr. Healy acted as a legal advisor to the permitting team for the $12 billion Central Artery/Third Harbor Tunnel (CA/T) project, dealing with diverse regulatory requirements of the Massachusetts Department of Environmental Protection (DEP), the United States Environmental Protection Agency (EPA), and the United States Army Corps of Engineers (ACOE), among others. Mr. Healy assisted with the legal process on a number of permit issues before the Boston Conservation Commission, DEP Wetlands and Waterways, and ACOE, and with the preparation of the Final Supplemental Environmental Impact Report/Statement. He was a negotiator for the Executive Office of Transportation and Construction (EOTC) in the attempt to reach a settlement agreement among EOTC, the Massachusetts Highway Department (MHD), and the City of Cambridge, regarding the Charles River Crossing. Mr. Healy worked with the ACOE to develop factual and legal support allowing the ACOE to make jurisdictional determinations on aspects of the CA/T project. In addition, he represented MHD in a wetlands adjudicatory proceeding challenging construction of the Third Harbor Tunnel, a proceeding that was resolved successfully in record time. He assisted the Office of the Attorney General with the defense of litigation instituted by the Conservation Law Foundation of New England and others attempting to enjoin the CA/T project for alleged violations of NEPA, parkland protection statutes, historic preservation requirements, the CAA, and MEPA. Mr. Healy also delivered legal opinions supporting the disposal of dredged and fill materials on Governors Island in connection with the construction of the Third Harbor Tunnel.
- Cisco Systems, Inc. New England Campus. Boxborough and Littleton, MA. Mr. Healy represented Cisco Systems, Inc. in connection with land acquisition, tax incentives, resolution of land use litigation, and permitting for proposed development of over 2,000,000 s.f. on three sites.
- Mail Processing Facility. Waltham, MA. Mr. Healy has assisted the United States Postal Service with environmental review and permitting associated with construction of a regional mail processing facility. He was part of the team dealing with compliance with the NEPA and MEPA, the DEP anti-degradation policy under the CWA, application of the Massachusetts Contingency Plan to site cleanup, and an adjudicatory proceeding before DEP under the Wetlands Protection Act.
- Boston Development. Mr. Healy has been counsel for acquisition and development of Two Financial Center (252,500 s.f.); the pre-development acquisition of 10 St. James (830,000 s.f.); development of the Park Square/One Charles Street Condominiums (400,000 s.f.); redevelopment of 25 New Chardon (96,000 s.f.); redevelopment of 170 Tremont Street (30,000 s.f.); redevelopment of the Ritz-Carlton on Newbury Street; permitting of 33 Arch Street for Frank King Associates (600,000 s.f.); redevelopment of Constitution Quarters in Charlestown Navy Yard as “Parris Landing” condominiums (678,000 s.f.); permitting for Building 114 and the Garage within the Boston Marine Industrial Park; master planning for a 30-acre, 3,000,000 s.f., mixed-use development in South Boston known as “Commonwealth Flats;” permitting the 1,100,000 s.f. mixed-use “Core Block” located within Commonwealth Flats; permitting of a new 82,500 s.f. intermodal cargo facility at 480 McClellan Highway, East Boston; permitting of the new (305,200 s.f.) intermodal cargo facility in Boston Marine Industrial Park; permitting of a new 415 foot 37-story, 551,733 residential tower at One Nashua Street next to the Garden; and permitting for the proposed 50,000 s.f. addition to Gardner Museum.

Mr. Healy has been selected for inclusion in Chambers USA: America’s Leading Lawyers for Business and The Best Lawyers in America. He serves on the Board of Editors of the Boston Bar Journal, and taught Land Use Planning and Development Law at Boston College Law School from 1984 to 1986.
Publications/Presentations
Mr. Healy is the editor of, and a contributing author to, the Massachusetts Zoning Manual (MCLE, 1989, revised 1992, 1995, 1999, 2002 and 2007). In addition, he is a frequent lecturer and author for Massachusetts Continuing Legal Education.
