Areas of Practice

Jim Broderick, a partner in the firm’s Real Estate Group, is currently chair of the firm’s Real Estate Investment Management Practice. Mr. Broderick primarily represents real estate investment advisors and other institutional investors in real estate transactions, with particular emphasis on structuring and implementing equity joint venture and sophisticated debt investments on behalf of institutional tax-exempt investors, their advisors and investment funds. He also has significant experience in the formation of commingled real estate investment funds, and has particular expertise in structuring subscription secured credit facilities on behalf of institutional investment funds. In addition, Mr. Broderick represents developers and noninstitutional investors in real estate acquisition, financing, development, zoning and land use matters.

Work for Clients

Mr. Broderick’s real estate investment management experience includes the following recently closed representative transactions:

  • Representation of a publicly traded REIT client in connection with the formation of a $1+ billion joint venture with third party investors to acquire the GM Building and three other office buildings in New York City.
  • Representation of Beacon Capital Partners LLC in connection with the acquisition of $1.5+ billion subscription secured credit facility for the client’s newly formed real estate investment fund. Unique challenges in this transaction included a variety of REITs and feeder funds in the deal structure, both domestic and foreign investment strategies for the fund, and utilization of the commercial paper (CP) market for borrowings.
  • Representation of a nationally recognized real estate investment management client in securing a $119 million construction loan for the development of a mixed use project in Virginia.
  • Representation of a nationally recognized real estate investment management client in the formation of a joint venture to develop a $130 million multifamily project in Florida.

Professional Activities

Mr. Broderick has been selected for inclusion in Chambers USA: America’s Leading Lawyers for Business and The Best Lawyers in America. He is a member of the Pension Real Estate Association, the Real Estate Financing Association, the Massachusetts Conveyancers Association, and the Boston and American Bar Associations. Mr. Broderick is also an associate member of the Town of Hingham (MA) Zoning Board of Appeals.

Publications/Presentations

Mr. Broderick has participated in numerous industry speaking engagements, including appearances as moderator of the “Intercreditor Agreements” panel at the IMN Conference on Real Estate Mezzanine Loans (December 2005); panelist on the “Subscription Secured Credit Facilities” discussion at the IMN U.S. Real Estate Opportunity and Private Fund Investing Forum (May 2003); and a featured speaker on “Real Estate Fund Formation” at the ABA Annual Property Symposium (April 2003).
