April Abele is a partner in Goodwin Procter's IP Litigation Group and a member of the firm’s Patent Litigation and Life Sciences Practices. Ms. Abele's patent practice includes litigation, opinion matters and strategic counseling and intellectual property aspects of M&A and capital markets transactions. She also has experience representing manufacturers and parent holding companies in individual toxic tort cases and class actions in federal and state courts.

Ms. Abele served as both a prosecutor and criminal defense attorney in the U.S. Navy’s Judge Advocate General’s Corps, where she tried numerous complex felony jury trials.

WORK FOR CLIENTS

Ms. Abele's principal focus is in the pharmaceutical, biotechnology, medical device and chemical industries. She has also represented clients in cases involving software, e-commerce and semiconductor design. Her recent representations include serving as counsel for:

  • Makhteshim Agan of North America (MANA) and Control Solutions (CSI) in a patent infringement action brought in North Carolina by BASF and Bayer on three patents relating to the pesticide fipronil. The district court granted MANA’s and CSI’s motion for summary judgment of no infringement, which was affirmed by the Federal Circuit.
  • Roxane Laboratories (Roxane) in a patent infringement action filed by Prometheus under the Hatch-Waxman Act in response to Roxane’s filing of an abbreviated new drug application (ANDA) for the pharmaceutical drug alosetron. The case is awaiting decision following trial.
  • Roxane Laboratories (Roxane) in a patent infringement action filed by Genzyme under the Hatch-Waxman Act in response to Roxane’s filing of an abbreviated new drug application (ANDA) for the pharmaceutical drug doxercalciferol. The case successfully settled.

Ms. Abele has authored numerous articles for scientific publications such as Brain Research, Neuron, Pharmacology of Cerebral Ischemia, Proceedings of the National Academy of Sciences, Society of Neuroscience Abstracts and Neuroscience Letters.

PROFESSIONAL EXPERIENCE

Prior to joining Goodwin Procter, Ms. Abele was a partner in the San Francisco office of Townsend and Townsend and Crew LLP. Before attending law school, she worked as a researcher at Harvard Medical School and The Children’s Hospital in Boston.

Ms. Abele is admitted to practice in California and the District of Columbia, and before the U.S. Patent and Trademark Office, the U.S. District Courts for the Central, Eastern, Northern and Southern Districts of California, the U.S. District Court for the Eastern District of Texas, and the U.S. Court of Appeals for the Federal Circuit.
