Benzene Basics

In the past few months, there have been an increasing number of “low dose” benzene cases filed in state courts across the country.  Plaintiffs’ lawyers appear to be applying the “asbestos model” to benzene litigation.  That is, by bringing “low dose” benzene cases, the plaintiffs’ bar is seeking to expand exponentially the number and types of individuals who claim benzene-related injuries.
 
Goodwin Procter hosted this one-hour webinar discussion about recent developments in the benzene litigation.  Topics discussed included what the plaintiffs are doing — the new types of cases that are being brought, new jurisdictions and defendants; legal developments relevant to benzene cases, including preemption, duty to household members, and forum non conveniens; developments in the Daubert/Frye area; and practical recommendations as to how to handle this changing litigation.
